  • Driver who hit child had previous DUI convictions

  •      Gregory Anthony Martinez, 53, of Dodge City was arrested for an alleged DUI July 18 night after police say he hit 6-year-old Briza Bustos.
         A representative at Wesley Medical Center in Wichita said Tuesday that Bustos is still hospitalized and in critical condition.
         According to Ford County Court records, Martinez's arrest involving Bustos was not the first time Martinez had been cited for a DUI. Records showed that the 53-year-old Dodge City resident was cited twice in 2005.  The charges were listed as his third and fourth convictions. Information on his first two DUI citations was not available but Ford County Attorney Terry Malone said his history of DUI citations date back to the end of the 1990's.
         Martinez plead no contest to a DUI April 18, 2005. The same court record indicated he was also found guilty of transporting an open container, refusing to take a breathalyzer test and driving in excess of the posted speed limit. He spent 90 days in jail, paid a $1610 fine and had his license suspended as a result of the charges.
         Martinez's second DUI in 2005 and his fourth DUl charge resulted from an Aug. 4 incident where he was brought in on charges of driving under the influence, refusing to take a breathalyzer test and disorderly conduct. Martinez completed a substance abuse treatment program and received a diversion on all of the charges. He also had to pay a fine of approximately $450.
         Martinez was arrested July 18 for the following alleged offense: DUI, reckless driving, failure to stop at accident that results in great bodily harm, duty of driver to report accident with an unattended vehicle, failure to give notice of accident involving great bodily harm, aggravated battery, driving left of center.
         Martinez's preliminary hearing is set for Aug. 2 at 1 p.m.
