Shortly before midnight Feb. 2, Luther Foote met his former girlfriend at her motel and took her to see a vacant apartment at 800 Central Ave.
The woman told Foote that a maintenance man was supposed to meet her at the apartment and show her around.
Foote dropped his former girlfriend off at the apartment before midnight, then left on a cigarette run. But he later returned the building, thinking she might have his lighter.
He went to the apartment door and knocked, then tried to open it, but without success.
Then Foote heard a scrambling sound inside, as if someone were rushing toward the door. A few seconds later, his former girlfriend rushed out the door, pursued by the maintenance man.
"She kept saying, 'He raped me. He raped me,'" Foote said Monday, adding that the woman was naked, screaming and crying.
Foote testified during the trial of Dodge City resident Willis S. Gordon, who is accused of raping a female acquaintance early the morning of Feb. 3. Gordon is also charged with attacking Foote, who tried to stop him from chasing the woman.
The prosecution says that Gordon held the woman captive in the apartment, confiscated her cell phone and sexually assaulted her.
But the defense contends that Gordon and the woman had consensual sex for money that night, and that Gordon attacked Foote in self-defense.
