A woman who sued Wal-Mart Stores after she fell outside the Dodge City store has settled her claim against the company for $50,000.
Buffalo, Okla., resident Janice "Claudette" Aitken and Wal-Mart settled the lawsuit earlier this month, Aitken's attorney, David Rebein, told the Globe on Tuesday. He said that Wal-Mart was not required to admit fault as part of the settlement.
Rebein said that he and his client were pleased with the settlement.
Wal-Mart was represented by Mitchell Herren with the Wichita law firm Hinkle Elkouri. Herren did not immediately return a call seeking comment on the lawsuit.
Aitken was leaving the Dodge City Wal-Mart on Feb. 14, 2007, when she slipped and fell on a patch of ice on the crosswalk outside a store entrance, suffering severe injuries, according to the lawsuit.
Aitken later sued Wal-Mart, alleging that it was responsible for inspecting the property for dangerous conditions, warning her of any danger and eliminating those conditions. Her lawsuit said that the company failed to take those steps, which resulted in her injury.
