An extremely rare Kansas legal proceeding will take place Tuesday, when the Daily Globe and the Ford County attorney square off in court over whether the newspaper should be forced to reveal confidential sources to the state. Local attorney Mike Giardine will represent the Globe.
The sources were quoted in an October 13 Globe article based on a jailhouse interview with Sam Bonilla, who is claiming self-defense in the Labor Day shooting death of Steven Holt.
Over the past 30 years, only one or two Kansas newspapers have been subpoenaed to testify at an inquisition, according to Kansas Press Association attorney Mike Merriam.
Merriam said he didn't consider that fact to be particularly significant in and of itself. But he said he would have filed a motion to quash the subpoena filed by Ford County Attorney Terry Malone if the Globe's owner, GateHouse Media, had not retained counsel for the newspaper.
