A statute passed by the Legislature during the prolonged and contentious state Supreme Court case Montoy v Kansas prohibits school districts from paying for education finance litigation with the state money in their general funds.
But because the law differentiates between categories of state funding, it's actually quite legal for schools to use a relatively large state funding source to do just that.
While district's can't use their general funds to sue the state over issues of school finance, they can pull money from their general supplemental funds to do so - and over 50 of them, including Dodge City's USD 443, are getting ready to do just that.
